4. VALIDITY PERIOD

After this preliminary information form is read and accepted by the Consumer electronically, the phase of establishing a consumer contract will begin.

5. RIGHT OF WITHDRAWAL

Consumer; In distance contracts for the sale of goods, the customer has the right to withdraw from the contract by rejecting the goods within 14 (fourteen) days from the date of delivery of the product to himself or to the person/organization at the address indicated, without assuming any legal or criminal liability and without giving any justification. Expenses arising from the exercise of the right of withdrawal belong to the SELLER. In order to exercise the right of withdrawal, the SELLER must be notified within 14 days by registered mail, fax, telephone or e-mail to the address stated above, and the product(s) must be undamaged as it reaches the BUYER. If the right of withdrawal is exercised, it is mandatory to return the copy of the cargo delivery report stating that the product(s) delivered to the ORDER/BUYER were sent to the SELLER and the original invoice to the SELLER. The price of the product(s) will be refunded to the ORDERER/BUYER within 10 days following the receipt of these documents. If the right of withdrawal is exercised within 14 days, the product(s) will be returned to the SELLER by cargo by the ORDERER/BUYER, and in this case the shipping fee belongs to the SELLER. If this right is used;

a) Invoice of the product delivered to the person or the BUYER,
b) Return form,
c) The products to be returned must be delivered complete and undamaged, along with their box, packaging and standard accessories, if any.

d) The SELLER is obliged to return the total price and the documents that put the buyer into debt to the BUYER within 14 days at the latest after receiving the notice of withdrawal.
e) If the value of the goods decreases or the return becomes impossible due to a reason arising from the BUYER's fault, the BUYER is obliged to compensate the SELLER's damages in proportion to the fault.

6. EXERCISE OF THE RIGHT OF WITHDRAWAL

6.1) BUYER declares that he has read and informed the preliminary information regarding the basic characteristics of the product subject to the contract, the sales price and payment method and delivery on the website https://vitruta.com/ and gives the necessary confirmation electronically. BUYER; By confirming this Preliminary Information electronically, before the conclusion of distance contracts, the SELLER confirms that it has obtained the address to be given to the BUYER by the SELLER, the basic features of the ordered products, the price of the products including taxes, and the payment and delivery information accurately and completely.
6.2) In distance contracts, the consumer has the right to withdraw from the contract within 14 (fourteen) days without giving any reason and without paying any penalty. It is sufficient to notify the BUYER that the right of withdrawal has been exercised within this period, in writing to the BUYER's e-mail address info@vitruta.com or to the full address at UNIT 96 COAL DROPS YARD, LONDON, N1C 4DQ, ENGLAND, or via a permanent data carrier. In contracts regarding the delivery of goods, the right of withdrawal starts from the day the consumer receives the goods, and in other contracts, from the day the contract is concluded.
6.3) The SELLER is responsible for delivering the product subject to the contract to Yurtiçi Kargo company in a sound, complete manner, in accordance with the qualifications specified in the order and with warranty documents and user manuals, if any.
6.4) The SELLER may supply a different product of equal quality and price by informing the BUYER and obtaining his express approval before the contractual performance obligation expires.
6.5) If the SELLER cannot fulfill its contractual obligations due to the impossibility of fulfilling the product or service subject to the order, it shall notify the consumer of this situation before the expiry of the contractual performance obligation and return the total price to the BUYER within 14 days.
6.6) For the delivery of the product, this Preliminary Information Form must be confirmed electronically. If the product price is not paid for any reason or is canceled in bank records, the SELLER is deemed to be free from the obligation to deliver the product.
6.7) After the delivery of the product, if the relevant bank or financial institution does not pay the price of the product to the SELLER due to the unfair or unlawful use of the BUYER's credit card by unauthorized persons, which is not due to the BUYER's fault, the BUYER will keep the product within 3 days, provided that it has been delivered to him. must be returned to the SELLER within In this case, shipping costs belong to the BUYER.
6.8) If the SELLER cannot deliver the product subject to the contract within the deadline due to force majeure or extraordinary circumstances such as adverse weather conditions that prevent transportation or interruption of transportation, the SELLER is obliged to notify the BUYER of the situation. In this case, the BUYER may exercise one of his rights to cancel the order, replace the product subject to the contract with a comparable product, if any, and/or postpone the delivery period until the hindering situation disappears. If the BUYER cancels the order, the amount paid will be paid in cash and in lump sum within 14 days.

7. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED

Unless otherwise agreed by the parties, the consumer cannot exercise his right of withdrawal in the following contracts.

a) There is no right of withdrawal in Distance Contracts written in Article 2/2 of the "Distance Contracts Regulation", which came into force after being published in the Official Gazette No. 29188 dated 11.2014.
b) The right of withdrawal cannot be exercised in the contracts/goods and services listed in Article 15 of the Distance Contracts Regulation, which came into force after being published in the Official Gazette dated 27.11.2014 and numbered 29188.

9. CONSUMER COMPLAINTS AND OBJECTIONS
